A teacher slapping a student, who then suffers fatal trauma

A doctor prescribing the wrong medication

Hitting someone with a light object that accidentally causes death

In such cases, there is no qisas. The punishment is usually payment of diya and a prison sentence (ta’ziri).

What Is Pure Accidental Killing?

Article 292 states that killing is purely accidental (khata-ye maḥz) when:

The perpetrator has no intent to kill,

And no intent to harm,

The death occurs accidentally or unknowingly.

Examples:

A driver accidentally hits and kills a pedestrian without fault

A hunter shooting at an animal, accidentally hitting a person

Dropping an object from a height without knowing someone is below

In such cases, diya is mandatory but paid by the perpetrator’s male relatives (called ‘Aaqelah’). No prison sentence is typically imposed.
