What Are the Conditions for Conditional Release (Parole) in Iran?

A Complete Legal Guide to Early Release from Prison in Iranian Criminal Law

Introduction

Conditional release, or parole, is one of the most important legal privileges available to convicts in Iran. It allows a prisoner to be released before completing their full sentence, under specific legal and behavioral conditions, while still being under court supervision. This system aims to encourage rehabilitation, reduce prison overcrowding, and help prisoners reintegrate into society gradually.

What Is Conditional Release (Parole)?

According to Article 58 of the Islamic Penal Code (2013 edition):

“In Ta’zir crimes, the sentencing court may grant conditional release after the prisoner serves the minimum required portion of the sentence, provided legal and behavioral conditions are met.”

Key Conditions for Parole in Iran

To qualify for parole, all of the following must apply:

Minimum Time Served

If the sentence is over 10 years → at least ½ of the sentence must be served

If the sentence is 10 years or less → at least ⅓ of the sentence must be served

Good behavior in prison (confirmed by prison authorities)

The court must find signs of rehabilitation

The convict must compensate the victim or attempt to reach a settlement

No serious prior criminal record (in most cases)

Note: Parole only applies to Ta’zir (discretionary) offenses — it is not available for Hadd crimes, Qisas (retribution), or certain national security cases.

How to Apply for Conditional Release

The prisoner or their lawyer submits a written application to the court via the Enforcement Unit

Behavioral report is prepared by the prison administration

The prosecutor’s office reviews the file and gives an opinion

The original sentencing court decides whether to approve parole

Conditions During the Parole Period

If the court approves the release:

The convict must reside at a specified address

Must not commit new offenses

May be required to provide periodic reports

May be monitored electronically in some cases

If the person violates the terms or commits a new crime, the parole is revoked and the remainder of the sentence must be served in full.

Role of a Lawyer in Parole Cases

A skilled lawyer can:

Gather and submit necessary documents and behavioral records

Assist in obtaining victim consent or compensation

Draft a strong legal motion for parole

Represent the prisoner in court hearings

Significantly increase the chances of early release

Conclusion

Conditional release is a legal opportunity for prisoners to return to society before completing their full sentence — but it comes with specific requirements. With proper preparation, good behavior, and legal advocacy, parole can ease the burden of imprisonment and promote a more humane approach to justice.
